Uncontested Divorce
You and your spouse want to get a divorce and agree on everything. This is an easy process and it does not need to cause you aggravation. It is important, however, that your uncontested Nevada divorce be handled correctly so that you don't have to go back to Court later to fix a mistake.
In order to file an uncontested divorce, you and your spouse must agree on everything. If you do not, then you will have to file for a contested divorce. The process of an uncontested divorce is relatively quick and easy. In most cases a Court hearing is not required. The couple provides a list of all assets and debts to be divided by the Court and their child custody and child support agreements then submits a Joint Petition for divorce, listing the terms of their agreement. The Decree of Divorce which will be entered by the Court will contain the same agreements as the Joint Petition. Uncontested divorces are typically finalized quickly, usually in less than a month. Occasionally, a judge will ask for a short hearing, known as a "prove up" hearing, to make sure that both parties understand the terms on which they are agreeing.
Many people think that they can take care of an uncontested divorce on their own, but they do not know what they are getting themselves into. Do-it-yourself forms have their uses, but many people do not understand what they are filling out. Making a mistake during an uncontested divorce can cost both of you time and money to finalize and when issues arise later on down the road. An attorney can catch and recognize these types of problems and help protect cases from becoming costly.
Our law firm assists clients in uncontested divorce, aiming to finalize legal matters in an efficient and time-effective manner. In general, it takes much less time to finalize an uncontested divorce than a contested divorce. When legal issues have already been agreed upon and parties are ready to move forward with legal proceedings, they also tend to be less costly.
Annulments
Marriages can be both void and voidable. A wedding occurs, but at the time of the marriage there was a problem with a party's ability to participate in the marriage such as a prior marriage that has not been legally dissolved. Entering into marriage with another person while still married makes the subsequent marriage invalid, and this voids the marital union, making an annulment easy to secure. A marriage can be voidable if lack of understanding or fraudulent circumstances were involved.
An annulment is a legal process by which the court determines that the marriage never existed. There are specific circumstances in which parties may wish to seek an annulment:
- Lack of consent to marriage
- Marriage was based on fraud or dishonesty
- Either party was married to another person at time of marriage
- Being under the influence of drugs or alcohol at the time of the marriage
- Statutory-based grounds
Not everyone qualifies for an annulment, so it is important to talk to a Nevada marriage annulment attorney about your specific legal options. Our firm has helped clients in a range of circumstances successfully get an annulment.
Because Las Vegas is the setting for many marriages for couples throughout the country, an annulment is not uncommon. If you and your new spouse have second thoughts following a Las Vegas marriage, you can seek to annul the union without being a resident of the state. If you were married outside the state, you must be a resident for at least six weeks to seek an annulment in Nevada. Our clients have included people who have gotten married in Las Vegas unexpectedly or without prior planning.
Even if you are not eligible for an annulment, if either party is a Nevada resident, you can proceed with seeking an uncontested divorce (or a contested divorce, if you and your spouse have certain disagreements).
