What is community property? What is separate property?

Community property includes all property, assets and debts that were obtained throughout the marriage. The marital home, vehicles, real estate property, artwork, bank accounts, businesses, pension plans, military retirement and more are assets subject to division. Credit card debt and other types of debt are also subject to division. Separate property includes assets you owned prior to marriage, inheritances, personal gifts and personal injury awards compensating for pain and suffering. Does fault play a role in property division?

Generally, fault does not play a role in how community property is divided. However, there is a concept called "community waste" that may be considered.
