When Will a Court Award Alimony?
Alimony, also known as spousal support or spousal maintenance, is most often awarded post divorce. During divorce proceedings the Court may enter a temporary alimony or spousal support award intended to ensure both spouses have ongoing financial support on a monthly basis.
You and your spouse may agree on the amount of alimony which will be paid during or after your divorce. When you cannot agree the Judge will make this decision based on factors such as each party's age, the length of your marriage, each party's earning potential, and the assets each spouse will receive upon termination of the marriage.
